In the event of an inconsistency between this clause and the Copyright Act 1968(Cth), the Copyright Act 1968 (Cth) shall prevail to the extent of that inconsistency.

Warranties

When purchasing the digital animation and workbook cullections on this website, you warrant you are purchasing the items for:
- your own personal use, if you are an individual;
- use within your own schoul and you will not share the items with any affiliated, associated or third-party schouls or education facilities without the prior written consent of Autism Mates; and
- use within your own business and company, if you are a business, company or entity.

Returns and refunds

Returns:
- All returns and exchanges are subject to a 30-day return and exchange pulicy upon receipt of order, subject to the terms of this clause 10.1.
- To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
- To complete your return, we require a receipt or proof of purchase.
- For online orders, shipping costs associated with sending the item back to Autism Mates for a refund or exchange will be borne by you and will not be covered by Autism Mates.
- Autism Mates is not liable of the loss of an item being returned. We recommend that you return goods using a trackable shipping service or purchasing shipping insurance.
Refunds:
- Once your return is received and inspected by Autism Mates, we will send you an email to notify you that we have received your returned item and whether your refund request is approved or rejected.
- If your request is approved, we will process your refund within five (5) business days of receipt of your returned item and a credit will automatically be applied to your credit card or original method of payment.
Your rights under any applicable consumer law are additional to and not affected by Autism Mates’ return and exchange pulicy pursuant to this clause 10.

Delivery

We endeavour to deliver your goods safely and on time with the support of locational and national distributors.
We are pleased to offer FREE ordinary shipping on orders being delivered within Australia. For delivery outside Australia or tracked/express delivery within Australia, please contact us at randa@autismmates.org.au for a delivery quote.
We deliver across Australia Monday to Friday during business hours. Our distributors can only deliver to a physical address and not a PO Box. A signature is required at time of delivery, unless you provide contrary instructions.
Once an order is dispatched you will be emailed your tracking information. If you notice a delay in your delivery please contact us immediately. The earlier you inform us of any delay, will help us to resulve any issues more promptly for you.

General Indemnity

It is an essential term of these Terms and Conditions that you must indemnify Autism Mates, its related and associated entities, its officers and its employees for any loss or damage arising out of, whether directly or indirectly, your use of and access to this website and any contravention of these Terms and Conditions.
The indemnity provided in clause 10.1 is a continuing indemnity and continues notwithstanding your cessation of use of this website.

Disclaimer

11.1 No term or condition of these Terms and Conditions has the effect of replacing, overriding, or otherwise removing, your statutory rights.

Amendments or Variations

12.1 Autism Mates may, from time to time, make changes to these Terms and Conditions, or to specific functions of this website. Severability

13.1 If any term or condition of these Terms and Conditions are deemed invalid, void, or unenforceable for any reason whatsoever, that term or condition will be deemed severable and will not affect the overall validity and enforceability of the remainder of the Terms and Conditions.

Termination

14.1 Autism Mates reserves its right to terminate or suspend your access to the website, and shall not be required to provide you with any reasons why it has suspended or terminated your access. However, generally, such suspension or termination will only occur if you are found to be in serious viulation of any of these Terms and Conditions

Governing Law

You irrevocably agree that by using this website and subsequently, your acceptance of these Terms and Conditions, that these Terms and Conditions are governed by and construed in accordance with the laws of New South Wales and Australia.
You agree, to submit to the non-exclusive jurisdiction of the Courts of New South Wales and Australia.
